R v DY - Blackfriars Crown Court

Mr Y was a minicab driver and was charged with Actual Bodily Harm (ABH) after it was alleged that he had come back to his minicab office and swung a car-jack at the head of his controller causing lacerations to his hands. Our preparation for the case concentrated on the delays in the police investigation and the lost opportunities to gather meaningful evidence. This included several officers attending the scene and all failing to record what several witnesses had to say about the incident, the CCTV was not seized at the earliest opportunity and subsequently became “lost”. Mr Y was not charged until almost a year had elapsed after the incident. The case proceeded to trial and our solicitor advocate Mr Nadeem Afzal represented. The jury acquitted by a unanimous verdict.
